Who these terms are with
These terms are an agreement between you and ToolzerHub, operated from India (“we”, “us”). If you use Toolzer Hub for an organisation, you accept them for that organisation and confirm you may do so.
By creating an account, creating an API key or buying credits, you agree to these terms. If you do not agree, do not use the service.
The service
Toolzer Hub provides an API that returns structured public web data from sites such as TikTok, Instagram, LinkedIn, Reddit, YouTube, Threads, the Meta Ad Library and Weibo, along with a dashboard at app.toolzerhub.com and documentation at docs.toolzerhub.com.
We also publish Actors on Apify; see “Apify Actors” below.
Accounts and eligibility
You must be at least 18 and able to enter a binding contract. The service is meant for business and professional use.
Give accurate details when you sign up and keep your email address current, since we use it for receipts and notices. You are responsible for everything done through your account and workspace, including by team members you invite.
API keys
- Keep your API keys secret. Do not put them in public code or in apps that run on your users’ devices.
- You are responsible for all calls made with your keys and for the credits they use.
- If a key may have been exposed, revoke it in the dashboard and tell us at once. Calls made before you revoke it are charged.
Free credits
Each workspace without a paid plan gets 100 free credits a month. They reset each month, do not roll over, and are spent before purchased credits. We may change or end the free allowance; the change applies from the next monthly reset.
Credits and payment
API calls are paid for with credits. Each endpoint’s documentation shows how many credits a call costs. We may change these costs with notice in the docs or by email; a change applies only to calls made after it takes effect.
What is charged. A call is charged when it returns a successful response, including one with no results. A call that returns an error (an HTTP status of 400 or above) is not charged. If a call is cut off by a failure on our side after work has started, it may be charged; tell us and we will return the credits.
Credit packs are one-time PayPal payments in US dollars. They do not renew and there is no automatic top-up. Credits are added once PayPal confirms the payment. Prices are on the pricing page and in the dashboard at the time you buy.
Purchased credits never expire while your account is open. They belong to the workspace that bought them and cannot be transferred or exchanged for money.
You are responsible for any taxes, duties and bank or currency fees that apply to your purchase, other than taxes we must collect, which we will show at checkout.
Monthly plans
Plans are PayPal subscriptions in US dollars, charged at the start of each monthly period until you cancel. Each payment adds that plan’s monthly credits to your workspace.
Plan credits you do not use carry over to the next period once and then expire. Plan credits are spent before purchased credits, the oldest first.
You can cancel at any time from Billing. Your plan and its credits stay active until the end of the period you paid for, and you will not be charged again. If a payment fails, the plan stops renewing and its credits stop refilling.
We may change plan prices with at least 30 days’ notice by email; the new price applies from your next period after the notice ends.
Refunds
Credit purchases and plan payments are final and not refundable. We will refund or credit you when:
- you were charged twice for the same purchase
- you paid but the credits were not added
- an error on our side charged credits that should not have been charged
- the law gives you a right to a refund
To ask, email contact@toolzerhub.com with your PayPal transaction ID.
Consumers in the EU and UK. Credits are digital content supplied as soon as payment is confirmed. By buying, you ask us to supply them immediately and acknowledge that you lose your 14-day right of withdrawal once they are added.
A refund, reversal or PayPal dispute removes up to the credits issued for that payment. If those credits were already used, API calls pause until the balance is settled. While a dispute or chargeback is open, we may suspend the account until it is resolved.
Acceptable use
You must not use the service or its data:
- to harass, stalk, threaten, dox or intimidate anyone
- to discriminate against people, or to monitor or track specific individuals
- to make decisions about a person’s eligibility for credit, employment, housing or insurance
- to target or profile children
- to send spam or run scams
- for anything illegal
You must not:
- try to access data that is private or behind a login, or ask us to
- get around rate limits, credit charges or other limits, for example by spreading calls across accounts
- share, sell or resell API keys or access to the API itself
- probe, overload or disrupt the service, or reverse engineer it
We may suspend or limit access without notice to stop abuse or protect the service, its users or the people in the data.
Using the data
You may use API results in your own products, train AI and machine learning models on them, and resell or redistribute them. Reselling the data is allowed; reselling access to our API is not.
You alone are responsible for how you use the data. In particular:
- Results can include personal data about people. You are the controller of that data and must have a lawful basis to collect and use it, and must follow the data protection laws that apply, such as the GDPR, UK GDPR, CCPA and India’s DPDP Act.
- You must comply with the terms of the sites the data comes from, as they apply to you.
- You must respect copyright, trademark and other rights in the content.
- If a person asks you to delete data about them, you must handle that request.
Toolzer Hub is not affiliated with or endorsed by TikTok, Instagram, Meta, LinkedIn, Reddit, YouTube, Google, X or Weibo. Their names and trademarks belong to their owners.
Data accuracy
Results come from public third-party sites and are provided as they are. They can be incomplete, out of date or wrong. Sites change their pages and can limit or block access, so an endpoint may return less data, fail, or stop working. Check anything important before you rely on it.
Availability and changes
We aim to keep the service available but do not promise any level of uptime. We may take it down for maintenance or fix problems without notice.
We may change, replace or retire endpoints. Before retiring an endpoint in regular use, we will give reasonable notice in the docs or by email, unless a source blocks access or the law requires faster action.
Your responsibilities as a controller
For personal data in results, you decide what to request and why. We process it only to answer your requests. You must give people any notices the law requires, answer their requests, and keep the data secure. Our Privacy Policy explains what we keep and for how long.
Our rights and your licence
We own the Toolzer Hub service, software, documentation, name and logo. These terms do not give you any of those rights except as stated here.
While you follow these terms, you may use the API and the results it returns as allowed under “Using the data”. We claim no ownership of what you build with them.
Apify Actors
Our Actors are listed, run and billed on Apify under Apify’s terms and prices. Toolzer Hub credits do not pay for Actor runs, and Apify handles Actor payments and refunds. “Acceptable use”, “Using the data” and “Data accuracy” also apply to data from our Actors.
Feedback
If you send us ideas or suggestions, we may use them without paying you or owing you anything.
Suspension and termination
You can stop using the service and delete your account at any time.
We may suspend or end your access if you break these terms, do not pay, put the service or others at risk, or if the law requires it. Where it is reasonable, we will tell you first and give you a chance to fix the problem.
If we end your account because you broke these terms, unused purchased credits are forfeited. If we stop offering the service, we will refund unused purchased credits in proportion to what you paid for them.
Sections on payment owed, data use, disclaimers, liability, indemnity and governing law continue after termination.
Disclaimers
The service and all data are provided “as is” and “as available”. To the extent the law allows, we make no warranties of any kind, including that the service will be uninterrupted or error-free, or that the data is accurate, complete or fit for a particular purpose.
Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive losses, or for lost profits, revenue, data or goodwill.
Our total liability for all claims about the service is limited to the amount you paid us in the 12 months before the event giving rise to the claim.
Nothing in these terms limits liability that cannot be limited by law, such as for fraud, or the statutory rights you have as a consumer.
Indemnity
You will defend and compensate us against claims, losses and costs, including reasonable legal fees, that arise from your use of the data, your breach of these terms, or your breach of law or of anyone else’s rights.
Events outside our control
We are not responsible for delays or failures caused by events outside our reasonable control, such as outages at providers or data sources, network failures, natural disasters or government action.
Changes to these terms
We may update these terms. We will post changes here with a new date. For material changes we will email account holders before they take effect. If you keep using the service after that, the new terms apply. If you do not agree, stop using the service before then.
Governing law
These terms are governed by the laws of India, and the courts of India have exclusive jurisdiction, except that consumers keep any right to bring a claim in the courts where they live.
General
If part of these terms cannot be enforced, the rest still applies. These terms, with the Privacy Policy and the pricing shown when you buy, are the whole agreement between us about the service. You may not transfer these terms without our consent; we may transfer them to a buyer of the service. Not enforcing a right is not giving it up.
